As an arbitrator for the State Bar of California appointed to
resolve fee disputes between attorneys and clients, our office realizes how important a
clear understanding of the financial arrangement is to the client. Each client is provided
with a specific engagement letter detailing fees and costs and sent regular monthly
invoices.
Fees are charged by our firm in one of two ways:
- Hourly fees are based on the length of time spent on
your case or matter. Abraham Lincoln once said "A lawyer's time is his stock in
trade." What he meant is that like a contractor selling houses, an automobile dealer
selling cars, or a farmer selling produce; a lawyer sells his commodity: time. The time
that is spent on your case is billed to you and represents your charges.
Hourly rates are charged in most litigation matters, many contract, drafting, negotiation,
or other matters in which the extent of the work or job to be done is not known or cannot
be determined.
- The second way fees can be charged are flat fees. This
is a set, agreed upon amount for a specified amount of work, the scope and extent of which
is known beforehand. Some matters such as corporate formation, wills, trusts, probates,
and bankruptcies can be charged as a flat fee.
Regardless of which manner is agreed upon out of pocket costs paid by the lawyer on
behalf of the client are reimbursed. These costs can be court filing fees, recorder fees,
outside experts and other related costs.
